In consideration of my use of the exercise equipment and facilities provided by GYM ON 5TH (hereinafter referred to as “the Gym”), I hereby understand and acknowledge that the equipment, training, programs and events held by the Gym may expose me to many inherent risks, including accidents, injury, illness, damages (both economic and non-economic), or even death.

I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that the Gym and its owners, insurers, employees, officers, directors, and associates, shall not be liable for any damages arising from any personal injuries (including death) sustained by me on or about the premises of the Gym, or as a result of the use of any of the equipment or facilities, regardless of whether such injuries result, in whole or in part, from the negligence of the gym or its owners and employees.
I understand that the Gym does not provide supervision, instruction, or assistance for the use of the facilities and equipment.

I assume all risk of injuries associated with participation including, but not limited to, falls, accidents, health conditions and attacks, contact with other participants, the effects of the weather, including high heat and/or humidity and all other such risks being known and appreciated by me.

I hereby acknowledge that it is solely my responsibility and I agree to be solely responsible for my own safety and well-being while at the Gym and to communicate any physical and psychological concerns that might conflict with my participation in any activity at the Gym.

I acknowledge that, at the time of signing this waiver, I am physically fit and mentally capable of performing the physical activity/ activities that I choose to participate in at the Gym.
I agree to comply with all rules imposed by the Gym regarding the use of its facilities and equipment. I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose.

I understand and agree that the Gym will not be responsible for any property that I may bring into the Gym and that if such property is lost, stolen, or damaged while in the Gym or on, or about the premises, the Gym will not be liable for any such loss or damage to my property.

After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and the GYM or any of its Trainers furnishing services to me, I expressly agree to indemnify and hold the Gym harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me. I am aware that this is a waiver and a release of liability and I voluntarily agree to its terms. This agreement shall continue in full force and effect for the duration of my membership at the Gym and no addition, variation, novation or cancellation of this waiver shall be of any force and effect unless agreed to by both myself and the Gym and reduced to writing. I will provide one months notice prior to the cancellation of my membership.
